1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of CarLinkers ("we," "our," or "us"), including our website at carlinkers.com and mobile applications (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

2. Service Description

CarLinkers is a lead generation marketplace that connects used car buyers with verified car dealerships.

2.1 For Buyers

Buyers can post vehicle requests specifying their desired vehicle and budget. Verified dealers can respond with offers. Buyers are not charged to use the basic Service.

2.2 For Dealers

Licensed car dealerships can subscribe to access buyer leads and submit competitive offers. Dealers must pay a monthly subscription fee and complete a verification process.

2.3 Limitations

CarLinkers is a lead generation platform only. We do not buy, sell, broker, or facilitate vehicle transactions. All negotiations and transactions occur directly between buyers and dealers outside of our platform.

3. User Accounts

3.1 Account Creation

• You must be at least 18 years old to use our Service
• You must provide accurate, current, and complete information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account

3.2 Account Types

• Buyer Accounts: Free to create and use
• Dealer Accounts: Require business license, verification, and paid subscription

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time through account settings. Deleted accounts cannot be recovered.

4. Dealer Subscription Terms

4.1 Eligibility

To subscribe as a dealer, you must:

• Be a licensed car dealership in good standing
• Provide valid business license documentation
• Complete our verification process
• Maintain an active business location

4.2 Subscription Tiers

We offer three subscription tiers:

• Basic ($99/month): Limited lead access
• Pro ($249/month): Increased leads + priority placement
• Premium ($499/month): Unlimited leads + featured status

Pricing subject to change with 30 days notice. Current subscribers maintain their price until renewal.

4.3 Billing and Payment

• Subscriptions renew automatically on a monthly basis
• Payment is processed via Stripe on the billing date
• Failed payments may result in service suspension
• All fees are non-refundable except as required by law
• You can cancel your subscription at any time (no partial refunds)

4.4 Lead Access

• Leads are shown based on location matching and subscription tier
• We do not guarantee any specific number of leads
• Lead quality and volume may vary by market and season
• We reserve the right to adjust matching algorithms

4.5 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial months.

5. Buyer Terms

5.1 Vehicle Requests

• Requests must be for actual vehicle purchases (no spam or fake requests)
• You may edit or delete requests at any time
• Requests expire after a set period (configurable in settings)
• Once you accept a dealer response, other responses are automatically declined

5.2 Dealer Responses

• Dealer responses are price estimates, not binding offers
• Final prices may vary based on actual vehicle condition and negotiation
• CarLinkers is not responsible for dealer accuracy or fulfillment
• All transactions occur directly between you and the dealer

5.3 No Fees for Buyers

Buyers are not charged fees to post requests or receive dealer responses. Our revenue comes from dealer subscriptions.

6. Prohibited Conduct

You agree NOT to:

• Provide false or misleading information
• Impersonate another person or entity
• Use the Service for fraudulent or illegal purposes
• Spam, harass, or abuse other users
• Scrape, data mine, or use automated tools without permission
• Attempt to gain unauthorized access to our systems
• Upload malware, viruses, or harmful code
• Violate any applicable laws or regulations
• Circumvent or manipulate our pricing or matching systems
• Create multiple accounts to abuse the Service

7. Intellectual Property

7.1 Our Property

All content, features, and functionality on CarLinkers (including but not limited to text, graphics, logos, software, and designs) are owned by CarLinkers and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of content you submit (vehicle requests, photos, messages). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content as necessary to provide the Service.

7.3 Feedback

Any feedback, suggestions, or ideas you provide about CarLinkers become our property, and we may use them without restriction or compensation to you.

8. Disclaimers

8.1 No Guarantees

CarLinkers is provided "AS IS" and "AS AVAILABLE." We do not guarantee:

• Availability, uptime, or uninterrupted access
• Accuracy of dealer information or responses
• Quality or completion of vehicle transactions
• Any specific results or outcomes from using the Service

8.2 Third-Party Conduct

We are not responsible for the conduct of dealers or buyers on our platform. You interact with other users at your own risk. We recommend meeting in public places and exercising caution.

8.3 Not a Broker

CarLinkers is not a car dealer, broker, or finance company. We do not sell cars, arrange financing, or handle transactions. We simply connect buyers with dealers.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARLINKERS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from transactions between buyers and dealers
• Unauthorized access to or alteration of your content
• Third-party conduct or content

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS (OR $100 IF YOU HAVE NOT PAID US).

10. Indemnification

You agree to indemnify and hold harmless CarLinkers, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the Service
• Transactions with other users

11. Dispute Resolution

11.1 Informal Resolution

Before filing a claim, you agree to contact us at support@carlinkers.com and attempt to resolve the dispute informally. We will do the same if we have a dispute with you.

11.2 Arbitration

If we cannot resolve a dispute informally, you agree to resolve it through binding arbitration rather than court (except for small claims court). Arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association rules.

11.3 No Class Actions

You agree to bring claims only in your individual capacity, not as part of a class action or representative proceeding.

12. Governing Law

These Terms are governed by the laws of the State of [Your State], without regard to conflict of law principles. Any disputes not subject to arbitration will be resolved in the state or federal courts located in [Your County/State].

13. Changes to Terms
